Behavior Analyst Licensure in Alabama: BCBA and State License Requirements

Founder, BehavioralHires
Last verified September 2026

Alabama licenses behavior analysts at two levels, the licensed behavior analyst and the licensed assistant behavior analyst, under Title 34, Chapter 5A of the Code of Alabama.

Current BACB certification is written into both licences: the statute names the Behavior Analyst Certification Board as the state's certifying entity.

Unlicensed practice is prohibited unless an exemption applies, assistants must document ongoing supervision, and the board says Registered Behavior Technicians need no licence.

Licences renew on the board's calendar to a December 31 expiry.

Licensing rules change by statute and board rule, and this page is career information, not legal advice. Confirm every requirement with the state board before you apply, register for an exam or count supervised hours. In Alabama, that is the Alabama Behavior Analyst Advisory Council, Alabama Department of Mental Health.

At a glance

State credential

Two licences: the licensed behavior analyst and the licensed assistant behavior analyst, each defined as certification by the certifying entity at the matching level plus the criteria in Ala.

Code § 34-5A-4.

Regulator

The Alabama Behavior Analyst Advisory Council sits in the Department of Mental Health; applications and fees go to the Mental Health Commissioner under § 34-5A-4.

BCBA as the route

Yes, and the statute names the BACB outright: the certifying entity is 'The nationally accredited Behavior Analyst Certification Board, Incorporated' (§ 34-5A-1(4)), and a licensed behavior analyst applicant must maintain active BCBA status after passing the BCBA examination (§ 34-5A-4(2)).

Assistant credential

Licensed assistant behavior analyst: active BCaBA status after passing the BCaBA examination, plus proof of ongoing supervision by a licensed behavior analyst who is a current national board certified behavior analyst, consistent with the certifying entity's requirements (§ 34-5A-4(3)).

Technicians and RBTs

No technician licence.

The board page states 'A license is not required for Registered Behavior Technicians', and § 34-5A-2(c)(2) separately exempts an applied behavior analysis direct contact technician, or a family member implementing a plan, acting under the extended authority and direction of a licensee.

Practice or title protection

Both.

Unlicensed practice of behavior analysis is prohibited unless exempted (§ 34-5A-2(a)), and no one may hold themselves out as a licensed behavior analyst or licensed assistant behavior analyst without satisfying the chapter (§ 34-5A-2(b)).

Governing law

Code of Alabama Title 34, Chapter 5A (Act 2014-163); every section read also carries a 2026 amendment, Act 2026-144, whose contents were not reviewed.

Rules: Ala.

The Alabama credential ladder

  1. Applied behavior analysis direct contact technicianOther

Not a credential: the statute defines a direct contact technician as an individual who directly implements applied behavior analysis services, and exempts them — or a family member implementing a behavior analysis plan in the home — while acting under the extended authority and direction of a licensed behavior analyst or licensed assistant behavior analyst (Ala.

    Code §§ 34-5A-1(2); 34-5A-2(c)(2)).

  2. Licensed assistant behavior analystOther

A licence for an individual certified by the certifying entity as a national board certified assistant behavior analyst who satisfies the criteria in § 34-5A-4, including proof of ongoing supervision by a licensed behavior analyst who is a current national board certified behavior analyst (Ala.

    Code §§ 34-5A-1(7); 34-5A-4(3)).

  3. Licensed behavior analystIndependent

The licence required to practise behavior analysis in Alabama, issued to an individual certified by the certifying entity as a national board certified behavior analyst who satisfies the criteria in § 34-5A-4 (Ala.

    Code §§ 34-5A-1(8); 34-5A-4(2)).

Two licences, and practising without one is barred

📜 Ala. Code §§ 34-5A-1(7), (8); 34-5A-2(a), (b), (d)

Alabama issues two licences: the licensed behavior analyst and the licensed assistant behavior analyst, each defined in § 34-5A-1 as a person certified by the certifying entity at the matching level who also satisfies the criteria in § 34-5A-4.

Unlicensed practice is prohibited unless an exemption in § 34-5A-2(c) applies, and no one may hold themselves out as a licensed behavior analyst or licensed assistant behavior analyst without meeting the chapter.

A violation is punishable by a fine of not more than one thousand dollars ($1,000), suspension or revocation of a licence, or both.

Applications and fees go to the Mental Health Commissioner, the executive officer of the Department of Mental Health.

For how BACB certification and a state licence fit together, see BACB certification vs. state behavior analyst licensure.

“No individual shall hold himself or herself out to be a licensed behavior analyst or licensed assistant behavior analyst unless he or she satisfies the applicable requirements of this chapter.”

The route runs through the BACB, by name

📜 Ala. Code § 34-5A-1(4); § 34-5A-4(1), (2)

Alabama writes no degree or coursework rule of its own.

The statute defines the certifying entity as 'The nationally accredited Behavior Analyst Certification Board, Incorporated', so the BACB is named outright and the sections read give no alternative-body route.

An applicant shows good moral character and compliance with the certifying entity's professional and ethical compliance code for behavior analysts, and completes a criminal background check under the chapter's rules: two complete sets of fingerprints and a sworn form, at the applicant's cost, submitted through the Mental Health Commissioner for a state criminal history record check.

A BCBA who moves to Alabama is certified on arrival but not licensed until that application clears.

The BACB’s own degree, coursework, fieldwork and exam requirements are covered in how to become a BCBA.

“a licensed behavior analyst applicant shall also maintain active status as a national board certified behavior analyst, as recognized by the certifying entity, following passage of the national board certified behavior analyst examination.”

The BACB examinations are the licensing examinations

📜 Ala. Code § 34-5A-4(2), (3)

The exam requirement is embedded in certification: a licensed behavior analyst applicant maintains active BCBA status following passage of the BCBA examination, and an assistant applicant maintains active BCaBA status following passage of the national board certified assistant behavior analyst examination.

The sections read name no separate Alabama examination.

Assistants must prove supervision; technicians and trainees work under it

📜 Ala. Code §§ 34-5A-2(c)(2), (6), (7); 34-5A-4(3)

Supervision obligations attach at the assistant tier and around it.

A licensed assistant behavior analyst applicant must provide proof of ongoing supervision by a licensed behavior analyst who is a current national board certified behavior analyst, in a manner consistent with the certifying entity's requirements, so losing your supervisor is a licensing problem, not just an employment one; the board's application page includes a Proof of Supervision Form for assistant applicants.

A matriculated graduate student or postdoctoral fellow is exempt when directly supervised by a licensed behavior analyst in this state or an instructor in a course sequence approved by the certifying entity.

An unlicensed person pursuing experience consistent with the certifying entity's requirements is exempt only when a licensed behavior analyst in this state supervises it, which is the hook for accruing fieldwork hours in Alabama.

“(2) An applied behavior analysis direct contact technician, or family member implementing a behavior analysis plan within the home or other environment in which the individual is located, who acts under the extended authority and direction of a licensed behavior analyst or a licensed assistant behavior analyst.”

What the licence covers, and who is exempt

📜 Ala. Code §§ 34-5A-1(10); 34-5A-2(c)(1), (3), (4), (5)

The practice of behavior analysis is the design, implementation and evaluation of instructional and environmental modifications to produce socially significant improvements in human behavior, including functional assessment and analysis.

It does not include psychological testing, psychotherapy, cognitive therapy, sex therapy, psychoanalysis, hypnotherapy or long-term counseling as treatment modalities, and it does not include preventing, alleviating or curing diseases or injuries.

The exemption list covers psychologists, physicians practising medicine, other licensed professionals working within their own scope who do not represent themselves as behavior analysts, and behavior analysts serving nonhuman or nonpatient clients such as applied animal behaviorists and organizational behavior management practitioners.

School employees have no exemption of their own in the list.

“Nothing in this chapter shall be construed as permitting or allowing a licensed behavior analyst to prescribe or administer any drug, make a medical diagnosis, provide medical treatment, or manage a medical condition.”

Moving to Alabama: reciprocity and the temporary licence

📜 Ala. Code §§ 34-5A-5; 34-5A-6

Reciprocity turns on two conditions: your home state's licensing requirements must be comparable to Alabama's, and it must offer reciprocity to individuals licensed under the Alabama chapter.

The applicant adds proof of ethical compliance, including current licensing and current certification by the certifying entity, along with any other eligibility requirements such as satisfactory passage of a criminal background check; the board's application page directs out-of-state licensees to a Licensure Verification Form.

Section 34-5A-5 also creates a temporary licence for a BCBA or BCaBA, licensed or unlicensed, who resides and practises elsewhere but temporarily provides services in Alabama or to an Alabama resident; it is available only where the services will be delivered during a limited and defined period, as defined by rule.

The reciprocity section speaks only of behavior analysts, and the sections read say nothing about reciprocity for assistants.

“The department shall issue a license to an individual who is actively licensed as a behavior analyst in another state that currently imposes comparable licensing requirements as those imposed in this state and that offers reciprocity to individuals licensed under this chapter.”

Every licence expires December 31 on the board's calendar

📜 Alabama Behavior Analyst Advisory Council website (mh.alabama.gov)

The statute sections read do not cover renewal; the board page sets the calendar.

Licences are active for up to 2 years and all expire on December 31 of the year following the year of issue, so a licence issued at any point in 2025 expires December 31, 2026.

The renewal deadline is December 15, and a $50 late fee applies after it; the page also describes a 45 day reinstatement period.

Fees are nonrefundable and nontransferable.

The sources read state no Alabama continuing-education rule and do not say whether renewal requires current BACB certification, so confirm renewal conditions with the council.

“Licenses are active for up to 2 years depending on the date when your license is issued; all licenses expire on December 31 of the year following the year when issued.”

A 2026 amendment the sources do not review

📜 Ala. Code §§ 34-5A-1 to -6 (history: Act 2014-163; Act 2016-400; Act 2026-144, § 3)

Every section read carries the history note '(Act 2014-163, p. 465 …; Act 2026-144, §3.)', so Act 2026-144 amended chapter 5A in 2026, and what it changed was not reviewed in the sources read.

Sections 34-5A-4 and 34-5A-6 also show an earlier amendment, Act 2016-400, §1.

The chapter was enacted by Act 2014-163, and the sources read give no date on which the licence requirement took effect.

Verifying a licence before you hire

📜 Alabama Behavior Analyst Advisory Council website (mh.alabama.gov)

The council posts a current roster of active licences that agencies and individuals can check, and will confirm by email a licensee who does not appear on it; the page notes a missing licensee may be inactive, may have opted out of the public directory, or may have been licensed after the list was generated.

For an employer, the roster is the state-side check on a candidate's licence; the board page points to the BACB's own website, www.bacb.com, for the certification layer.

Frequently Asked Questions

I am a BCBA moving to Alabama. Is certification enough to start work?

No. The board page states that Alabama requires a licence to practise applied behavior analysis, and Ala.

Code § 34-5A-2(a) prohibits unlicensed practice unless an exemption applies.

BACB certification is the route, not a substitute: your application to the Mental Health Commissioner must show active BCBA status, good moral character, compliance with the BACB ethics code, and a completed criminal background check.

Reciprocity under § 34-5A-6 may apply if your state's requirements are comparable and it reciprocates for Alabama licensees.

Apply before you start.

Do Registered Behavior Technicians need an Alabama licence?

No. The council's page says 'A license is not required for Registered Behavior Technicians'.

Separately, § 34-5A-2(c)(2) exempts an applied behavior analysis direct contact technician, or a family member implementing a behavior analysis plan in the home, who acts under the extended authority and direction of a licensed behavior analyst or licensed assistant behavior analyst.

Note the exemption's condition: outside it, the chapter's bar on unlicensed practice applies.

Employers and payers can still set their own credential requirements.

Who can supervise BCBA fieldwork hours in Alabama?

Under § 34-5A-2(c)(7), an unlicensed individual pursuing experience consistent with the certifying entity's requirements is exempt only when the experience is supervised by a licensed behavior analyst in this state — the exemption names an Alabama licensee.

Graduate students and postdoctoral fellows have a parallel exemption under (c)(6) for direct supervision by a licensed behavior analyst in this state or an instructor in a course sequence approved by the certifying entity.

The administrative rules at chapter 580-5-30B were not read, so confirm details with the council.

I am licensed in another state. Can I take a short Alabama assignment?

Possibly, through the temporary licence in § 34-5A-5.

It covers a BCBA or BCaBA, licensed or unlicensed, who resides and practises in another state and temporarily provides behavior analysis services in Alabama or to an Alabama resident.

The temporary licence is available only if the services will be delivered during a limited and defined period, as defined by rule, so it is not a route to ongoing practice.

For permanent work, § 34-5A-6 reciprocity requires comparable home-state requirements and reciprocal treatment of Alabama licensees.

When does an Alabama behavior analyst licence expire, and what are the renewal deadlines?

The council's renewal page sets the calendar: licences are active for up to 2 years and all expire on December 31 of the year following issuance, so a licence issued any time in 2025 expires December 31, 2026.

Renewal is due by December 15; a $50 late fee applies after that date, and the page describes a 45 day reinstatement period.

The sources read state no Alabama continuing-education requirement, so ask the council what your renewal must include.
