Colorado licenses behavior analysts under the Applied Behavior Analysis Practice Act, C.R.S. article 247 of title 12, created by HB26-1425 in 2026.
Two licences exist: licensed behavior analyst and licensed assistant behavior analyst, both routed through a current certification with a certifying entity such as the BACB or the Qualified Applied Behavior Analysis Credentialing Board.
The licence requirement takes effect July 1, 2028 β until then no state licence is needed.
Supervised technicians stay exempt, and the article sunsets September 1, 2031.

Two licences created by the Applied Behavior Analysis Practice Act: licensed behavior analyst and licensed assistant behavior analyst.
The act took effect on passage in June 2026, but the licence requirement itself takes effect July 1, 2028 β Colorado requires no behavior analyst licence before then.
The Colorado Behavior Analyst Licensing Board, five members appointed by the governor β three licensed behavior analysts, one licensed assistant behavior analyst, one public member β exercising its functions under DORA's Division of Professions and Occupations.
Yes, through the certifying entity.
A licensed behavior analyst needs a current, valid certification in good standing as a certified behavior analyst, certified behavior analyst-doctoral, or qualified behavior analyst, or another certification the board determines; the act names the Behavior Analyst Certification Board and the Qualified Applied Behavior Analysis Credentialing Board.
Licensed assistant behavior analyst: a current, valid certification as a certified assistant behavior analyst or qualified autism service practitioner-supervisor (or another board-determined certification), a fingerprint check, and practice only under the supervision of a licensed behavior analyst.
No state registration.
Supervised behavior technicians are excluded from the article and must use a nonprofessional title, though a technician who holds a certifying-entity credential may use its title, such as Registered Behavior Technician.
Medicaid must reimburse applied behavior analysis delivered by certified behavior technicians.
Both, from July 1, 2028: section 12-247-106 bars engaging in or offering the practice of applied behavior analysis without a licence and restricts the licensed behavior analyst and licensed assistant behavior analyst titles.
Unlicensed applied behavior analysis practice is a class 2 misdemeanor under section 12-20-407, added by HB26-1425 Β§ 3.
C.R.S. title 12, article 247, created by HB26-1425 (signed June 2, 2026; effective on passage), with sections 12-247-106, -110, -112 and -118 taking effect July 1, 2028 and the article repealed September 1, 2031.
Not a state credential: article 247 excludes a behavior technician providing applied behavior analysis services under the supervision of a licensed behavior analyst or licensed assistant behavior analyst (C.R.S. Β§ 12-247-115(1)(b)), and the act's technician definition builds in practising in accordance with a certifying entity's requirements (Β§ 12-247-103(2)).
A licence for an individual holding a current certification as a certified assistant behavior analyst or qualified autism service practitioner-supervisor, or another certification the board determines, who completes a fingerprint check β and who may practise only under the supervision of a licensed behavior analyst (§§ 12-247-108; 12-247-112).
The licence required to practise applied behavior analysis in Colorado from July 1, 2028, issued to an individual with a current, valid certifying-entity certification as a certified behavior analyst, certified behavior analyst-doctoral, or qualified behavior analyst, plus a fingerprint check (Β§ 12-247-107).
Colorado's act created two licences with a delayed trigger.
The board and the qualification sections took effect when HB26-1425 passed in June 2026, but the sections that bar unlicensed practice and protect the titles (12-247-106, 12-247-118) do not take effect until July 1, 2028.
Until then, practising applied behavior analysis in Colorado without a state licence is lawful; from July 1, 2028, an individual who is not licensed, or exempt under section 12-247-115, may not engage in or offer the practice.
Title protection covers the two licensed designations; the act as read does not restrict the bare job title behavior analyst itself.
Practising without a licence after the switch is a class 2 misdemeanor.
For how BACB certification and a state licence fit together, see BACB certification vs. state behavior analyst licensure.
βEXCEPT AS OTHERWISE PROVIDED IN SECTION 12-247-115, AN INDIVIDUAL SHALL NOT ENGAGE IN OR OFFER TO PROVIDE THE PRACTICE OF APPLIED BEHAVIOR ANALYSIS UNLESS THE INDIVIDUAL IS LICENSED UNDER THIS ARTICLE 247.β
Colorado writes no degree or coursework rule of its own: the licence qualification is the credential.
An applicant for licensed behavior analyst must hold a current, valid certification in good standing with a certifying entity as a certified behavior analyst, certified behavior analyst-doctoral, or qualified behavior analyst, or another certification the board determines, and complete a fingerprint-based criminal history record check whose costs the applicant pays.
Certifying entities are the Behavior Analyst Certification Board, the Qualified Applied Behavior Analysis Credentialing Board, or another national entity the board identifies whose programs are accredited by the NCCA or ANSI.
Licensees must also carry professional liability insurance in an amount the board sets by rule, unless they are public employees covered by governmental immunity.
When applications open, and what the board's first rules will say, is not stated in the sources read.
The BACBβs own degree, coursework, fieldwork and exam requirements are covered in how to become a BCBA.
The act's exam requirement is the certifying entity's own: qualification for either licence rests on the certification, not on a Colorado-administered test.
Neither the licensed behavior analyst section nor the licensed assistant behavior analyst section names a state examination or a jurisprudence exam.
The board may adopt rules to implement article 247, and the sources read do not say what those rules will require, so whether Colorado adds an exam of its own is not stated here.
Check the application instructions before you file.
Supervision is load-bearing at every level below the full licence.
A licensed assistant behavior analyst shall practise only under the supervision of a licensed behavior analyst, with the supervision requirements and the assistant's scope of practice set by board rules that are not yet written.
A licensed behavior analyst supervises an appropriate number of assistants and behavior technicians as determined by the board, and failing to provide required supervision is a ground for discipline.
Technicians are excluded from the article while supervised, and the act's technician definition bakes in practising in accordance with a certifying entity's requirements while barring technicians from designing assessment or intervention plans.
Students in a qualifying program, and unlicensed people accruing supervised experience toward certification under board requirements, are excluded too β so fieldwork can proceed.
βA BEHAVIOR TECHNICIAN PROVIDING APPLIED BEHAVIOR ANALYSIS SERVICES UNDER THE SUPERVISION OF A LICENSED BEHAVIOR ANALYST OR A LICENSED ASSISTANT BEHAVIOR ANALYST PURSUANT TO SECTION 12-247-115 (1)(b) SHALL NOT REPRESENT THEMSELVES AS A LICENSED BEHAVIOR ANALYST AND SHALL USE A TITLE THAT INDICATES THEIR NONPROFESSIONAL STATUS, SUCH AS "ABA TECHNICIAN", "BEHAVIOR TECHNICIAN", OR "TUTOR".β
Article 247 defines applied behavior analysis as the design, implementation and evaluation of instructional and environmental modifications to produce socially significant improvements in human behavior, including functional assessment and analysis, and the licence requirement applies to the practice in all settings.
The definition carves out what the licence does not cover: diagnosis, psychological testing, psychotherapy, cognitive therapy, psychoanalysis, mental health counseling, practice with nonhumans, and business or organizational consulting including organizational behavior management services.
A licensed behavior analyst develops the individualized treatment plan and supervises; a licensed assistant may perform any function a licensed behavior analyst performs if supervised.
Excluded groups include Title 12 health-care professionals practising within their scope and competence who do not use the protected titles, caregivers, students, experience-seekers, and school employees β who may not serve non-students or take outside pay.
A clinician licensed elsewhere moves to Colorado through endorsement: the board shall issue a licence by endorsement to an applicant who satisfies the occupational credential portability program described in section 12-20-202(3), the state's general portability law.
The sources read do not include that program's details, so what documentation or showing it requires is not stated here.
Timing does the real work: until July 1, 2028 no Colorado licence is required, so a behavior analyst arriving before then can work on the strength of their certification and employer requirements alone.
From July 1, 2028, an out-of-state licensee needs the Colorado licence, and a current certifying-entity certification plus a fingerprint check are the route in.
A Colorado licence is valid for the period set by the state's standard licensure statute, section 12-20-202; the specific term, fees and grace-period length are not stated in the sources read.
Renewal takes a completed application under board rule and board verification of the licensee's certification with a certifying entity.
Continuing competency is the credential itself: licensees shall maintain their certifying-entity credential, practise in accordance with its requirements and board rules, and notify the board immediately if that credential is suspended or revoked.
In practice, Colorado renewal and certifying-entity recertification move together β a lapsed certification is a licence you cannot renew.
βINDIVIDUALS LICENSED PURSUANT TO THIS ARTICLE 247 SHALL MAINTAIN THEIR PROFESSIONAL CREDENTIAL ISSUED BY A CERTIFYING ENTITY AS DESCRIBED IN SECTION 12-247-107 (1)(a) OR 12-247-108 (1)(a), AS APPLICABLE, AND SHALL PRACTICE IN ACCORDANCE WITH THE REQUIREMENTS OF THE CREDENTIAL AND IN ACCORDANCE WITH RULES ADOPTED BY THE BOARD.β
HB26-1425 became law in June 2026, with the governor's signature recorded June 2, 2026 and the act effective on passage.
The board takes shape first: the governor appoints its five members within 180 days of that section's effective date.
From July 1, 2028 the licence mandate, title protection and renewal sections switch on and an unlicensed, non-exempt individual may not practise.
HB26-1425 Β§ 3, effective on passage, adds unlicensed applied behavior analysis practice to the class 2 misdemeanors listed in section 12-20-407.
The same act directs Medicaid to reimburse applied behavior analysis services delivered by certified behavior technicians, with one temporary uncertified period of not less than 45 days subject to federal approval, and directs the department of human services to prescribe and publish standards for licensing and regulating applied behavior analysis clinics on or before July 1, 2029.
The whole article sunsets September 1, 2031 unless reviewed.
This page summarizes the Colorado statute, rules, board pages and other documents cited above, as read for this state-by-state behavior analyst licensure series, current as of September 2026.
It does not list application forms, fees beyond those cited above, or processing times, and it is not a substitute for the instructions the Colorado Behavior Analyst Licensing Board (Division of Professions and Occupations, Department of Regulatory Agencies) publishes.
Hour totals, exams and supervision rules change by statute and by board rule; for how BACB certification and a state licence fit together, see BACB certification vs. state behavior analyst licensure.
Confirm every requirement with the Colorado Behavior Analyst Licensing Board (Division of Professions and Occupations, Department of Regulatory Agencies) before you count hours, register for an exam or apply β and before you take one of the board certified behavior analyst jobs in Colorado that asks for it.
No. Section 12-247-106, which bars engaging in or offering the practice of applied behavior analysis without a licence, takes effect July 1, 2028 under section 23 of HB26-1425; until then Colorado issues no mandatory behavior analyst licence.
The board and the qualification sections are law now, but when applications open is not stated in the sources read.
If you plan to stay past July 1, 2028, watch the Colorado Behavior Analyst Licensing Board's rules as they are adopted.
No state registration exists for behavior technicians.
Article 247 excludes a behavior technician providing services under the supervision of a licensed behavior analyst or licensed assistant behavior analyst, and a technician must use a title showing nonprofessional status β unless they hold a credential such as the Registered Behavior Technician, whose title they may use when performing within it.
For Medicaid payment the technician must be certified by a certifying entity, with one temporary uncertified period of not less than 45 days subject to federal approval.
Before July 1, 2028 you need no Colorado licence.
After that date, article 247 requires one: apply to the Colorado Behavior Analyst Licensing Board with your current certifying-entity certification and a fingerprint-based criminal history record check, or seek licensure by endorsement under section 12-247-111, which goes to applicants who satisfy the state's occupational credential portability program.
The portability program's details were not in the sources read, so confirm the documentation with the board before your move.
You need a current, valid certification in good standing with a certifying entity as a certified assistant behavior analyst or a qualified autism service practitioner-supervisor, or another certification the board determines, plus a fingerprint-based criminal history record check.
The licence lets you practise only under the supervision of a licensed behavior analyst, within a scope of practice the board's rules will set.
Those rules were not in the sources read, so confirm the supervision requirements with the board before you rely on them.
Unauthorized practice carries penalties under section 12-20-407, and HB26-1425 adds engaging in the practice of applied behavior analysis without a licence to the offenses punished as a class 2 misdemeanor.
The board may also deny, suspend or revoke licences, impose probationary conditions, issue cease-and-desist letters and seek injunctions, and violating the article's requirements β including letting your certifying-entity credential lapse without notifying the board β is a ground for discipline.
Confirm your status with the board if you are unsure.
