Behavior Analyst Licensure in North Carolina: BCBA and State License Requirements

Founder, BehavioralHires
Last verified September 2026

North Carolina licenses behavior analysts at two levels under Article 43 of Chapter 90: the licensed behavior analyst and the licensed assistant behavior analyst.

Certification is the route β€” an applicant needs the certifying entity's BCBA exam and active BCBA status.

Practising without a licence, or holding oneself out as practising behavior analysis, is a Class 2 misdemeanor.

Technicians need no state credential; licences renew every two years on the certifying entity's paper.

Verify before you rely on this

Licensing rules change by statute and board rule, and this page is career information, not legal advice. Confirm every requirement with the state board before you apply, register for an exam or count supervised hours. In North Carolina, that is the North Carolina Behavior Analysis Board (its site calls itself the North Carolina Behavior Analyst Licensure Board, NCBALB).

At a glance

State credential

Two licences: licensed behavior analyst and licensed assistant behavior analyst, created by Article 43 of Chapter 90 (S.L.

2021-22).

Both rest on the certifying entity's examination and active certification.

Regulator

The five-member board created by G.S.

90-733.

The statute itself uses two names: G.S.

90-732(3) says "North Carolina Behavior Analyst Board" while G.S.

90-733 says "Behavior Analysis Board"; the board's site calls itself the North Carolina Behavior Analyst Licensure Board (NCBALB).

BCBA as the route

Yes.

An applicant must have passed the certifying entity's Board Certified Behavior Analyst examination and hold active status with the certifying entity as a Board Certified Behavior Analyst (G.S.

90-737(2), (3)); the certifying entity is the BACB or the Qualified Applied Behavior Analysis Credentialing Board.

Assistant credential

Licensed assistant behavior analyst: age 18 or older, the certifying entity's Board Certified Assistant Behavior Analyst examination and active status, plus an ongoing supervision arrangement with a licensed behavior analyst (G.S.

90-738).

Technicians and RBTs

No state registration.

The Article defines the behavior technician and exempts technicians delivering applied behavior analysis services under the extended authority and direction of a licensed behavior analyst, licensed assistant behavior analyst, or other qualifying licensed professional (G.S.

90-745(2)); RBT certification is not mentioned.

Practice or title protection

Both, and the ban is on practice: unlicensed practice and holding oneself out to the public as practising behavior analysis are each violations β€” a Class 2 misdemeanor, with each violation a separate offense (G.S.

90-746).

Governing law

G.S.

90-731 to 90-747, Article 43, "Behavior Analyst Licensure" (S.L.

2021-22; the board's site says SB 103 was signed in May 2021), with G.S.

90-732 amended by S.L.

2023-129 s.4.1.

The date the licence requirement took effect is not stated in the sources read.

The North Carolina credential ladder

  1. Behavior technicianOther

Not a credential: the Article defines the behavior technician as a paraprofessional who delivers applied behavior analysis services under the close, ongoing supervision of a licensed behavior analyst, licensed assistant behavior analyst, or other qualifying licensed professional, without designing assessment or intervention plans, and exempts technicians working under a supervisor's extended authority and direction (G.S.

    90-732(2); 90-745(2)).

  2. Licensed assistant behavior analystOther

A licence for an individual certified by the certifying entity as a Board Certified Assistant Behavior Analyst whose licence is active and not suspended or revoked, and which permits the holder to engage in the practice of behavior analysis only under the supervision of a licensed behavior analyst (G.S.

    90-732(6)).

  3. Licensed behavior analystIndependent

The licence required to practise behavior analysis in North Carolina, issued to an individual certified by the certifying entity as a Board Certified Behavior Analyst whose licence is active and not suspended or revoked (G.S.

    90-732(7); 90-737).

Two licences, and the ban covers practice and holding out

πŸ“œ G.S. 90-732(6), (7); 90-746; 90-747

North Carolina issues two licences.

The licensed behavior analyst is an individual certified by the certifying entity as a Board Certified Behavior Analyst who holds an active, unsuspended licence under the Article; the licensed assistant behavior analyst adds the condition that the licence permits practice only under the supervision of a licensed behavior analyst (G.S.

90-732(6), (7)).

The restriction reaches further than the two titles: practising behavior analysis without a licence is itself a violation, and so is holding oneself out to the public as practising it.

Each violation counts as a separate offense and the conduct is a Class 2 misdemeanor (G.S.

90-746(b)); the board may also apply to the Superior Court of Wake County for an injunction (G.S.

90-747).

For a certified BCBA, certification alone does not authorize practice in North Carolina.

For how BACB certification and a state licence fit together, see BACB certification vs. state behavior analyst licensure.

β€œExcept as permitted in G.S. 90-745, it shall be a violation of this Article for any individual not licensed under this Article to practice behavior analysis or to hold oneself out to the public as an individual practicing behavior analysis.”

The route: certification by the BACB or the QABA board

πŸ“œ G.S. 90-732(4); 90-737; 90‑734(a)(3); 90‑736; 90‑744

Article 43 writes no degree or coursework rule of its own β€” the education rides on certification.

An LBA applicant must be at least 18, have passed the certifying entity's Board Certified Behavior Analyst examination, and hold active status with the certifying entity as a Board Certified Behavior Analyst, alongside the qualifications the board sets under its G.S.

90-734(a)(3) rulemaking power (G.S.

90-737; 90-734(a)(3)).

The board's rules were not read, so state-added qualifications are possible.

The application must show good moral character, no practice history that would ground denial under G.S.

90-742, and the criminal history record required by G.S.

90-744; a licence obtained through fraud is void (G.S.

90-736).

A conviction is not an automatic bar β€” the board weighs all six factors: the crime's seriousness and date, age at conviction, the circumstances, the nexus between the conduct and the job's duties, and the record since (G.S.

90-744(c)).

The certifying entity is defined as the BACB or the Qualified Applied Behavior Analysis Credentialing Board; how the board applies that second branch is not stated in the sources read.

The BACB’s own degree, coursework, fieldwork and exam requirements are covered in how to become a BCBA.

β€œThe nationally accredited Behavior Analyst Certification Board, Inc., or its successor, or the nationally accredited Qualified Applied Behavior Analysis Credentialing Board, or its successor.”

The certifying entity's exam is the licensing exam

πŸ“œ G.S. 90-737(2); 90-738(2); 90‑734(a)

The statute's exam requirement is the certifying entity's own: LBA applicants must have passed the Board Certified Behavior Analyst examination and LABA applicants the Board Certified Assistant Behavior Analyst examination (G.S.

90-737(2); 90-738(2)).

Article 43 names no separate North Carolina exam.

The board does hold rulemaking power to adopt, amend or repeal rules to administer and enforce the Article (G.S.

90-734(a)(2)), and the implementing rules were not read for this page, so whether the board adds any state-specific examination is not stated in the sources read.

Check the board's application instructions before you schedule around this.

Assistants, technicians and people still counting hours

πŸ“œ G.S. 90-738(4); 90-732(2); 90-745(7), (8); 90‑739(b)(4)

Supervision is written into the lower tiers.

A LABA applicant needs an ongoing supervision arrangement with a licensed behavior analyst, and renewal requires fresh evidence of it β€” so for an assistant, losing an LBA supervisor is a licensing problem, not just an employment one (G.S.

90-738(4); 90-739(b)(4)).

The behavior technician practises under the close, ongoing supervision of a licensed behavior analyst, licensed assistant behavior analyst, or other Chapter 90 or 90B professional within that professional's scope, and does not design assessment or intervention plans (G.S.

90-732(2)).

Two exemptions cover people still accruing experience: students in a defined college course program, practicum or intensive practicum supervised by a licensed behavior analyst, an instructor in a certifying-entity-approved course sequence, or a qualified faculty member; and people pursuing the certifying entity's experience requirements under the supervision of a licensed behavior analyst (G.S.

90-745(7), (8)).

Read together, exemption (8)'s experience route requires a licensed behavior analyst, while the college-program route in exemption (7) also accepts an approved course-sequence instructor or a qualified faculty member.

β€œThe applicant has an ongoing arrangement for supervision by a licensed behavior analyst in a manner consistent with the certifying entity's requirements for supervision of Board Certified Assistant Behavior Analysts.”

What behavior analysis is, what it is not, and who is exempt

πŸ“œ G.S. 90-732(1), (8); 90-745; 90-270.154

Behavior analysis is the design, implementation and evaluation of systematic instructional and environmental modifications to produce significant personal or interpersonal improvements in human behavior, and the practice expressly includes the empirical identification of functional relations β€” functional assessment and analysis (G.S.

90-732(1), (8)).

It just as expressly excludes modalities that belong to other professions.

The exemption list keeps those lines: exemption (1) covers licensed psychologists and psychological associates and people who provide ancillary services in accordance with G.S.

90-270.154, and exemption (6) covers professionals licensed under Chapter 90 or 90B acting within scope so long as they do not represent themselves as licensed behavior analysts or licensed assistant behavior analysts (G.S.

90-745(1), (6)); the list also covers family members, guardians and caretakers implementing a plan, nonhuman work, organization-serving work with no direct services, college programs, and experience-seekers (G.S.

90-745(3)–(8)).

One gap for school-based roles: none of the eight exemptions names school employees, so a BCBA practising behavior analysis in a North Carolina school setting appears to need the licence unless another exemption covers the arrangement β€” confirm with the board.

β€œThe practice of behavior analysis expressly excludes psychological testing, cognitive therapy, sex therapy, psychoanalysis, hypnotherapy, and long‑term counseling as treatment modalities.”

Moving to North Carolina: reciprocity and the temporary licence

πŸ“œ G.S. 90‑741; 90‑740; 90‑743(4), (5)

Reciprocity carries a two-way condition: the board shall license an individual actively licensed as a behavior analyst or assistant behavior analyst in another state only when that state imposes licensure requirements comparable to North Carolina's and offers reciprocity to North Carolina licensees (G.S.

90-741(a)).

The application then adds proof of ethical compliance, proof of current licensure, proof of current certification by the certifying entity, a criminal history record check, and any other eligibility requirement the board deems appropriate (G.S.

90-741(b)).

For short engagements there is a separate route: an actively licensed or certified behavior analyst who resides and practises elsewhere may apply for a temporary licence, available only for services delivered during a limited and defined period of service the board approves (G.S.

90-740).

The statute caps the money: no more than $250 for a reciprocal application and $100 for a temporary application (G.S.

90-743(4), (5)).

β€œThe Board shall issue a license to an individual who is actively licensed as a behavior analyst or assistant behavior analyst in another state that currently imposes comparable licensure requirements as those imposed by this Article and that offers reciprocity to individuals licensed under this Article.”

Two-year licences, renewed on the certifying entity's paper

πŸ“œ G.S. 90‑739; 90‑742(h); 90‑743

A licence runs for two years.

Renewal takes proof of completion of any continuing education the certifying entity requires, the renewal fee, evidence of active certification by the certifying entity and, for licensed assistant behavior analysts, evidence of the ongoing supervision arrangement (G.S.

90-739(b)).

The design makes North Carolina renewal ride on BACB recertification: let the certification lapse and the evidence of active certification is gone, so the licence cannot be renewed.

A licence is suspended automatically by operation of law when renewal is more than 60 days late; the board may reinstate it on payment of a fee and may require a new application, references, updated credentials or an examination (G.S.

90-742(h)).

The statute caps the fees at $250 to apply, $200 to renew, and $50 for a late renewal (G.S.

90-743(1)–(3)); the board's rule-set fees within those caps were not read for this page.

β€œA license shall be granted under this Article for the period of two years.”

A 2021 law, with one 2023 amendment to the definitions

πŸ“œ G.S. 90-732; S.L. 2021-22; S.L. 2023-129 s.4.1; NCBALB website

Article 43 is recent: S.L.

2021-22 created it, and the board's site records Governor Cooper signing SB 103 in May 2021.

The saved statute shows one amendment from 2023 to 2026: S.L.

2023-129 s.4.1 amended the definitions section, G.S.

90-732.

The history note does not say which subdivision changed; as printed, the section carries the behavior-technician definition and the practice definition with its exclusions sentence, so the amendment's exact effect is not established by the sources read.

Every other section of the Article still shows only the 2021-22 enactment history in the saved text, and the sources read do not establish the date on which the licence requirement first applied β€” only the May 2021 signing is recorded.

Frequently Asked Questions

I hold BCBA certification. Can I work as a behavior analyst in North Carolina without a state licence?

Not unless an exemption in G.S.

90-745 covers what you do.

G.S.

90-746 makes it a violation β€” a Class 2 misdemeanor, with each violation a separate offense β€” for an individual not licensed under the Article to practice behavior analysis or hold themselves out to the public as practising it.

BCBA certification is the route to the licence, not a substitute: G.S.

90-737 requires the certifying entity's BCBA examination and active status as a BCBA on the application.

Apply to the North Carolina Behavior Analysis Board before you begin practice.

Do RBTs or behavior technicians need a North Carolina credential?

No state registration or certification exists for technicians.

The Article defines the behavior technician as a paraprofessional who delivers applied behavior analysis services under the close, ongoing supervision of a licensed behavior analyst, licensed assistant behavior analyst, or other qualifying licensed professional, and exempts technicians working under a supervisor's extended authority and direction (G.S.

90-745(2)).

The statute does not mention RBT certification.

Employers and payers may still require it, and the exemption depends on the supervision arrangement holding, so confirm the specifics of your role with the board.

I am licensed as a behavior analyst in another state. How do I move to North Carolina?

Two routes exist.

Reciprocity under G.S.

90-741 requires that your state imposes licensure requirements comparable to North Carolina's and offers reciprocity to North Carolina licensees, plus proof of ethical compliance, current licensure, current certification by the certifying entity, a criminal history record check, and any other eligibility requirement the board deems appropriate.

For time-limited engagements, G.S.

90-740 offers a temporary licence to an out-of-state licensed or certified behavior analyst when the board approves a limited and defined period of service.

Comparability is the board's call, so confirm eligibility with the board before relocating.

How often does a North Carolina behavior analyst licence renew?

Every two years.

Renewal under G.S.

90-739 requires proof of any continuing education the certifying entity requires, the renewal fee, evidence of active certification and, for licensed assistant behavior analysts, evidence of the supervision arrangement.

A licence is suspended automatically by operation of law when renewal is more than 60 days late, and reinstatement can require a new application, references, updated credentials or an examination (G.S.

90-742(h)).

Because renewal turns on the certifying entity's paperwork, keep your BACB certification current.

Can a licensed behavior analyst in North Carolina provide therapy or psychological testing?

No. The practice of behavior analysis expressly excludes psychological testing, cognitive therapy, sex therapy, psychoanalysis, hypnotherapy, and long-term counseling as treatment modalities (G.S.

90-732(8)).

The licence covers designing, implementing and evaluating behavioral interventions, including functional assessment and analysis β€” not those modalities.

Professionals licensed in other North Carolina fields provide them under their own licences, and G.S.

90-745(6) exempts them from Article 43 so long as they do not represent themselves as licensed behavior analysts or licensed assistant behavior analysts.

Ask the board where a planned service falls.
