Kentucky licenses psychiatric nurse practitioners as advanced practice registered nurses through the Kentucky Board of Nursing, and AANP classes the state as reduced.
Prescribing runs through two physician agreements β a CAPA-NS for nonscheduled legend drugs and a CAPA-CS for Schedules II through V β until four years of prescribing ends each.
The rule that shapes psychiatric practice: Schedule II prescriptions are capped at a 72-hour supply without refill, and the 30-day psychostimulant prescription is confined to psych-certified APRNs in a KRS 216B facility or a KRS 210 regional program.

Advanced practice registered nurse (APRN).
A provisional applicant is an advanced practice registered nurse applicant (APRNA) for up to six months.
The Kentucky Board of Nursing.
The Kentucky Board of Medical Licensure is notified of every CAPA-NS and CAPA-CS and audits the physician's collaboration-meeting records.
Reduced, per AANP's State Practice Environment map (updated 05/2026).
AANP's label, not a legal category.
Four years of prescribing exits each agreement: CAPA-NS by notice, licence in good standing; CAPA-CS after a board good-standing review (four years of controlled-substance prescribing under a CAPA-CS, DEA registration and a KASPER master account maintained).
Two: a CAPA-NS for nonscheduled legend drugs and a CAPA-CS for Schedules II-V on a standardized form, each with a Kentucky-licensed physician qualified in the same or a similar specialty.
First CAPA-CS year: at least quarterly reverse-KASPER meetings; then at least biannual.
No ratio cap was located.
A 72-hour supply without any refill (hydrocodone combination products: 30 days).
Psychostimulants may be written for a 30-day supply only by a psych-certified APRN inside a KRS 216B health facility or a KRS 210 regional program; outside those settings, the 72-hour, no-refill cap applies.
Schedule III: a 30-day supply without any refill.
Schedules IV-V: the original prescription and refills up to a six-month supply.
A CAPA-CS may set stricter limits.
Not enacted in Kentucky.
The compact is not in effect anywhere: it needs seven states and five had enacted it as of September 2026.
A provisional licence for an applicant who has met every licensure requirement but the national certification exam, expiring no later than six months from issuance.
An APRNA may function as an APRN except for prescribing medications and only under a mentorship with an advanced practice registered nurse or a physician; a second failed exam attempt terminates it.
The licence the Kentucky Board of Nursing issues to a certified nurse practitioner, clinical nurse specialist, certified nurse midwife or certified registered nurse anesthetist certified in at least one population focus β for the PMHNP, psychiatric-mental health.
The statute protects the title and abbreviation, and no one may practise as an APRN without it.
Prescribing is added by the two agreements below.
Prescriptive authority for nonscheduled legend drugs under a written Collaborative Agreement for the Advanced Practice Registered Nurse's Prescriptive Authority for Nonscheduled Legend Drugs with a physician licensed in Kentucky, qualified in the same or a similar specialty.
The board is notified of the agreement and passes the collaborating physician's name to the Kentucky Board of Medical Licensure.
Schedules II-V prescriptive authority on the standardized CAPA-CS form, within the schedule day-supply limits of KRS 314.011(8).
Requires a DEA registration reported to the board and a KASPER (Kentucky All Schedule Prescription Electronic Reporting) master account before prescribing controlled substances.
After four years of prescribing, the CAPA-NS ends on notice to the board, provided the licence is in good standing β if not, it stays until the licence is restored β and the CAPA-CS ends after the board's good-standing review and written notice.
The APRN then prescribes legend and controlled substances without a physician agreement β Kentucky's route out of the reduced tier.
The board conducts random KASPER audits of exempt prescribers and may reimpose a CAPA-CS through a KRS 314.091(1) action.
AANP's May 2026 map puts Kentucky in its reduced tier.
The label is AANP's advocacy classification; the legal fact behind it is that Kentucky splits prescribing into two agreements.
Before prescribing nonscheduled legend drugs, the APRN enters a written CAPA-NS with a physician licensed in Kentucky; before prescribing Schedules II through V, a written CAPA-CS on a standardized form, also with a Kentucky-licensed physician.
The agreements govern prescribing only β the APRN licence itself comes from the Board of Nursing, and practice decisions outside prescriptions do not require either agreement.
For a PMHNP the practical reading is that the physician relationship follows the prescription pad, in two pieces with different exit rules.
For what AANPβs full, reduced and restricted tiers mean, see can a PMHNP practice independently?
βshall enter into a written "Collaborative Agreement for the Advanced Practice Registered Nurse's Prescriptive Authority for Controlled Substances" (CAPA-CS) on a standardized CAPA-CS form with a physician licensed in Kentuckyβ
Kentucky's statutes build an exit from both agreements onto a four-year clock β the route AANP's reduced label does not show.
For legend drugs: after four years of prescribing as a nurse practitioner, clinical nurse specialist, nurse midwife or nurse anesthetist β for NPs and CNSs the four years must be in a population focus β an APRN in good standing notifies the board and stops needing the CAPA-NS; there is no review step, and the agreement may be kept voluntarily.
If the licence is not in good standing, the CAPA-NS stays until it is restored.
For controlled substances the exit is gated: four years of controlled-substance prescribing with a CAPA-CS, a maintained DEA registration and a maintained KASPER master account earn only the right to request board review, with a fee due whether or not the exemption is granted.
βAn advanced practice registered nurse shall not prescribe controlled substances without a CAPA-CS until the board has completed its review and has notified the advanced practice registered nurse in writing that the advanced practice registered nurse is exempt from the CAPA-CS requirement.β
Both agreements are with a Kentucky-licensed physician qualified in the same or a similar specialty; the board judges that from the facts and the scope of each party's actual practice.
For an APRN who has not had a CAPA-CS, a CAPA-CS in the first year of licensure requires employment by a health care entity or provider; an APRN employer must hold the four-year exemption.
Meetings run at least quarterly in the first CAPA-CS year, then at least biannually, in person or by video, reviewing the APRN's reverse KASPER report.
Records are kept one year past expiry; each board audits its own licensee's records.
A CAPA-CS is rescinded on thirty (30) days written notice; a CAPA-NS on written notice alone.
If an agreement ends unexpectedly for reasons outside the APRN's control, the rule allows thirty (30) days of continued prescribing with documented per-patient justification, not extendable or successive β but the violations section ties the grace period to legend drugs only, so confirm controlled-substance prescribing with the board.
No ratio cap appears in the sources read.
For who signs these agreements and what they cost, see PMHNP collaborative practice agreements.
βIn the first year of the CAPA-CS, the advanced practice registered nurse and the physician shall meet at least quarterly, either in person or via video conferencing, to review the advanced practice registered nurse's reverse KASPER reportβ
The schedule limits decide psychiatric prescribing.
Every APRN Schedule II prescription is limited to a 72-hour supply without any refill, except hydrocodone combination products at a 30-day supply without refill.
Psychostimulants may be written for a 30-day supply only by an APRN certified in psychiatric-mental health nursing providing services in a KRS Chapter 216B health facility or a KRS Chapter 210 regional mental-health or intellectual-disability program.
An APRN outside those settings is held to the 72-hour, no-refill Schedule II supply, and whether a given outpatient clinic qualifies as a KRS 216B health facility is not defined in the sources read β confirm with the board.
Schedule III is capped at a 30-day supply without refill; Schedules IV-V at the original prescription plus refills up to a six-month supply.
APRNs may prescribe but not dispense Schedules II-V, and a CAPA-CS may impose stricter limits.
The rule adds workflow: a PDMP query at least once every three months per patient, and the federal 90-day split-prescription mechanism (21 CFR 1306.12(b)) does not apply to Kentucky APRNs.
For the federal DEA rules on prescribing controlled substances by telehealth, see prescribing controlled substances by telehealth.
βPrescriptions issued under this subsection for psychostimulants may be written for a thirty (30) day supply only by an advanced practice registered nurse certified in psychiatric-mental health nursing who is providing services in a health facility as defined in KRS Chapter 216B or in a regional services program for mental health or individuals with an intellectual disability as defined in KRS Chapter 210.β
Before prescribing controlled substances, the APRN holds a DEA Controlled Substance Registration Certificate, reports the Kentucky DEA number and any status change to the board within thirty days of issuance, and registers for a PDMP master account within thirty days of the DEA certificate and before prescribing.
At an initial controlled-substance prescribing decision, an APRN certified in psychiatric-mental health must obtain a medical and psychiatric history, perform a mental health assessment and document both.
No separate state controlled-substance registration was located in the sources read β the DEA registration and the KASPER master account are the layers the rule names.
Federally, the DEA registers the PMHNP as a mid-level practitioner, and that registration covers only what Kentucky allows.
The DEA and HHS telemedicine flexibilities, extended through December 31, 2026, remove the federal in-person-visit requirement but lift no Kentucky limit β the CAPA-CS and the schedule caps bind telehealth prescriptions the same as in-person ones.
For how an FNP moves into psychiatric practice, see FNP to PMHNP.
Kentucky has not enacted the APRN Compact.
The compact comes into effect only once seven states enact it, and five had as of September 2026 β Delaware, North Dakota, South Dakota, Utah and Wyoming β so no APRN holds a multistate APRN licence today.
The Nurse Licensure Compact is an RN compact and confers no nurse practitioner authority in another state.
To practise as a PMHNP in Kentucky you need a Kentucky APRN licence and, until the four-year exemptions land, the CAPA-NS and CAPA-CS agreements.
June 29, 2023 amendments to KRS 314.042 built the current CAPA-CS structure β the standardized form developed by a joint committee of the two boards, the first-year employment rule, the at-least-quarterly-then-biannual KASPER meetings and the four-year exemption β but the enacting bill number is not located in the text read.
201 KAR 20:057 was amended effective March 21, 2024 and February 13, 2025 (filed with the Legislative Research Commission on January 13, 2025).
One caution the sources flag: the KAR cites the CAPA-CS provisions and the exemption by subsection numbers that do not match the FindLaw statute text, so this page cites the rules by content, not subsection number.
The FindLaw statute text is as of January 1, 2025, and 2025-2026 session amendments were not checked.
Endorsement applicants get their own path onto the same four-year standard.
A CAPA-NS is not required for an APRN who met the prescribing requirements in a state that grants independent prescribing and has at least four years of prescribing, or who had a collaborative prescribing agreement with a physician in another state for at least four years.
Controlled substances run parallel: four years of controlled-substance prescriptive authority in a state that grants it, plus a licence in good standing under the review standard, exempts.
With fewer than four years, the rule sends the mover into a Kentucky CAPA-CS until the cumulative four-year mark, then the exemption request β so a mid-career relocation resets the clock to whatever remains, not to zero.

Yes, after four years β through two different exits.
For nonscheduled legend drugs, four years of prescribing (in a population focus for NPs and CNSs) ends the CAPA-NS on notice to the board, provided the licence is in good standing β if not, the requirement stays until it is restored; there is no review step.
For controlled substances, four years of prescribing under a CAPA-CS plus a maintained DEA registration and KASPER master account earn a board good-standing review, and prescribing without the CAPA-CS waits on the board's written notice.

The 30-day psychostimulant supply exists only in two settings: written by a psych-certified APRN providing services in a KRS Chapter 216B health facility or a KRS Chapter 210 regional mental-health or intellectual-disability program.
Outside them, the statute caps every APRN Schedule II prescription at a 72-hour supply without any refill β including stimulants.
Whether a given outpatient clinic qualifies as a KRS 216B health facility is not defined in the sources read.
A DEA registration does not widen the Kentucky limits.
Confirm with the Kentucky Board of Nursing.
Four years of prescribing, and each agreement exits separately.
A CAPA-CS in a newly licensed APRN's first year carries an employment gate: the APRN must be employed by a health care entity or provider.
In that first CAPA-CS year the physician meetings run at least quarterly to review the APRN's reverse KASPER report, and biannually for the ensuing three years.
After four years, legend-drug prescribing needs only notice, with the licence in good standing; controlled-substance prescribing needs the board's review and written notice before the CAPA-CS can go.
Maybe not both, if you have four years.
An APRN endorsed into Kentucky is exempt from the CAPA-NS if they met the prescribing requirements in a state that grants independent prescribing and have at least four years of prescribing, or held a collaborative prescribing agreement in another state for at least four years.
Controlled substances run parallel: four years of controlled-substance prescriptive authority plus a licence in good standing exempts; fewer than four years means a Kentucky CAPA-CS until the cumulative four-year mark.
Schedule III prescriptions are limited to a 30-day supply without any refill.
Schedules IV and V are limited to the original prescription plus refills not exceeding a six-month supply.
Kentucky APRNs may issue prescriptions for but not dispense Schedules II through V.
A CAPA-CS can also state its own limits, which may be more stringent than the statutory schedule caps, so read your agreement's terms before assuming the statute is the ceiling.
